Apollo Vid Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of Apollo Vid ("Apollo Vid"), operated at https://apollovid.com by:

In these Terms, "we", "us", and "our" refer to the operator identified above. The Service includes the website, applications, tools, APIs, and related services we provide.

By creating an account, connecting a social media account (including TikTok), or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You must also meet the minimum age and eligibility requirements of any third-party platform you connect (including TikTok). If you use the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

3. Description of the Service

Apollo Vid helps users turn long-form videos into short clips, generate captions and metadata, schedule posts, and publish content to connected social media accounts such as TikTok, YouTube, Instagram, Facebook, and X. Features may change over time. Some features require a paid subscription or connected third-party accounts. We may offer beta or experimental features that can change or be withdrawn at any time.

4. Account registration and security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

You agree to provide accurate account information and keep it up to date.

5. Your content and intellectual property

You retain ownership of videos, audio, images, text, and other content you upload or create through the Service ("User Content"). You represent and warrant that you own or have all necessary rights, licenses, and permissions to upload, process, clip, and publish User Content, including music, likenesses, trademarks, and third-party materials.

You grant Apollo Vid a limited, non-exclusive, worldwide license to host, store, reproduce, process, transcode, display, and distribute User Content solely to operate and provide the Service to you. This license ends when you delete the content or your account, except for copies retained in backups or as required by law.

The Service, including software, branding, and documentation, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks except as needed to identify your use of the Service.

6. Acceptable use

You agree not to:

• Upload or publish content you do not have rights to use.
• Violate any applicable law, regulation, or third-party rights.
• Publish spam, malware, deceptive content, hate speech, harassment, exploitation, or sexually explicit material involving minors.
• Circumvent technical limits, rate limits, or security measures.
• Reverse engineer, scrape, or misuse the Service except as permitted by law.
• Resell, sublicense, or provide unauthorized access to the Service or its processing capacity.
• Use the Service in a way that violates the terms or policies of connected platforms, including TikTok, YouTube, Meta, or X.

We may suspend or terminate accounts that violate these Terms or that create risk for other users or for Apollo Vid.

7. Connected third-party platforms and TikTok

The Service can connect to third-party platforms so you can publish content. When you connect an account, you authorize Apollo Vid to access and use platform credentials and data as described in our Privacy Policy and only to perform actions you request.

For TikTok, this includes using TikTok for Developers products (Login Kit and Content Posting API / Direct Post) to identify your connected account and to upload and publish videos you create or schedule in Apollo Vid. You remain solely responsible for:

• Complying with TikTok's Terms of Service, Community Guidelines, Music and intellectual-property rules, and Branded Content / commercial disclosure requirements.
• Complying with the TikTok Developer Terms of Service as they apply to your use of the integration through Apollo Vid.
• Selecting an accurate privacy level, captions, and disclosures for each post, and ensuring you have rights to any music, likeness, or brand materials included in the video.
• Ensuring that content you publish via Apollo Viddoes not violate TikTok's content policies or applicable advertising and consumer-protection laws.

Apollo Vid is not affiliated with, endorsed by, or sponsored by TikTok Inc. or its affiliates. We do not control third-party platforms and are not responsible for their availability, policies, moderation decisions, API changes, or account enforcement actions.

You may disconnect a platform at any time in the Service. Disconnecting stops future publishes through that connection. Content already published on the third-party platform remains subject to that platform's terms.

8. Subscriptions, billing, refunds, and fair use

Paid plans renew automatically on a monthly or annual basis unless cancelled before the renewal date. Fees are charged through our payment provider (Stripe). Taxes may apply.

Plan limits (such as clips per month, source duration, or connected accounts) exist to keep the Service reliable for all users. Automated abuse, attempts to bypass limits, or resale of processing capacity may result in suspension without refund.

Unless required by Brazilian consumer law (Código de Defesa do Consumidor) or other mandatory law, fees already paid are non-refundable. Where a mandatory cooling-off or refund right applies, we will honor it. You may cancel at any time; cancellation takes effect at the end of the current billing period unless otherwise required by law.

9. Service availability and modifications

We strive to keep the Service available, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with or without notice. Scheduled publishes may fail due to platform API outages, revoked tokens, account restrictions, or content moderation by third parties; we are not liable for those failures beyond reasonable efforts to surface errors in the Service.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, create legal or security risk, or if required by law or by a connected platform.

Upon termination, your right to use the Service ends. Sections that by their nature should survive termination will survive, including ownership provisions, disclaimers, limitations of liability, indemnification, and governing law.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, OR THAT PUBLISHED CONTENT WILL REMAIN AVAILABLE ON THIRD-PARTY PLATFORMS.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APOLLO TECHNOLOGY, S APOLLO M M DA SILVA, AND APOLLO VID WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100. Nothing in these Terms limits liability that cannot be limited under applicable mandatory consumer law in Brazil or your country of residence.

13. Indemnification

You agree to defend, indemnify, and hold harmless Apollo Technology, S Apollo M M da Silva, Apollo Vid, and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, your violation of these Terms, or your violation of any third-party rights or platform policies (including TikTok's).

14. Governing law and disputes

These Terms are governed by the laws of Brazil, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence provide otherwise. Courts in Caxias, Maranhão, Brazil shall have jurisdiction over disputes arising from these Terms, unless applicable law requires a different forum. Consumers in Brazil retain rights under the Código de Defesa do Consumidor.

15. Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Material changes may be communicated by email or in-product notice where required by law. Continued use after changes become effective constitutes acceptance of the updated Terms, except where applicable law requires additional consent.
